Medical Marijuana Industry and Political News

We never know what to expect in the medical marijuana world. Who knows which states will pass, ban, regulate, or vote on MMJ laws next? This week, Massachusetts hit the news as they will be one of the next states to vote this fall. Meanwhile, California continues to wage the “drug war” as Harborside Health Center was raided and feds hope to close it down – without concern for the 108,000 patients it serves. While this is dreary, the cause at least has the support of the speaker of the house, nancy Plosi, who once again reiterated her support for legalization. Read on for all the news!

Massachusetts Votes on Dispensaries: Supporters of the Massachusetts Medical Marijuana Initiative have gathered enough signatures to put it to a vote on November’s ballot. If passes, up to 35 dispensaries could be opened with home growing certificates awarded to those who live too far. Read more…

Feds Think Big Dispensaries = Illegal Activity: This week, Harborside Health Center was targeted for closure, “despite the fact that the Center appears to break no state or municipal laws,” according to MMJ Business Daily.  ”The larger the operation, the greater the likelihood that there will be abuse of the state’s medical marijuana laws, and marijuana in the hands of individuals who do not have a demonstrated medical need,” wrote US Attorney Melinda Haag. Support comes from an unlikely source this week as a notably conservative politician’s daughter publicly endorses marijuana legalization, while New York takes great steps in legalizing medical marijuana. Rhode Island meanwhile lessens the punishment for possessing marijuana; possessing an ounce or less will become a civil violation with a $150, like a ticket. Read on for the full stories.

California Hospital Denies transplant for Legal MMJ User

Patient Toni Trujillo has been on the Cedars-Sinai Medical Center’s transplant list waiting for a kidney for six years…until now. Trujillo has been using medical marijuana legally for two years to stimulate her appetite and increase and maintain protein levels while on dialysis, yet she was removed from the list for “substance abuse.”

This isn’t the first time this has happened, either.  Last year the hospital removed a man with inoperable liver cancer from their transplant list for the same reason – legally smoking marijuana. Without the transplant, doctors expect him to die within 90 days.

Sally Stewart, a spokesperson for the hospital, said marijuana users can be exposed to a type of mold that can cause deadly disease among patients whose immune systems are compromised. They also are at risk of a fatal lung infection after transplantation, she told the newspaper. “We do not make a moral or ethical judgment about people who are smoking medical marijuana. Our concern is strictly for the health and safety of our patients,” she said.

NY General Assembly Approves Medical Marijuana Bill; RI Decriminalizes

The same day that Rhode Island Governor Chafee signed a bill to decriminalize the possession of small amounts of marijuana, the New York State Assembly approved a bill to allow qualified patients to possess medical marijuana. The vote passed 90-50, setting a positive note for the Senate vote. Similar legislation have previously been stopped twice in the Senate, but supporters are optimistic for AB7347’s passing. Medical Marijuana News From Coast to Coast

Despite the setback in Los Angeles as a dispensary ban is considered, the medical marijuana cause is still going strong with very positive news across the country.  It’s still unclear if the Los Angeles ban, which would hurt both patients and the economy, will go into effect. Meanwhile, in Sacramento positive steps are being made for the regulation of medical marijuana. Even more encouraging is the fact that Connecticut has officially passed its medical marijuana law. Finally, New Jersey is on the verge of opening its first dispensaries.

California
Los Angeles
Earlier this week, a three-person council voted to shut down medical marijuana dispensaries in the Los Angeles area and outlaw new ones from opening. The city has struggled with regulation of distribution for years, but shutting down the dispensaries will only make it more difficult for patients to receive treatment and will leave hundreds unemployed. It is being argued that banning dispensaries will only take the industry back to dealing illegally – and dangerously.  A highly supported counterproposal was advanced to leave 100 dispensaries open.

Sacramento
In a 41-28 vote, the California State Assembly passed a bill that would regulate the production and distribution of medical marijuana for qualified patients. AB 2312, the Medical Marijuana Regulate, Control and Tax Act, was introduced earlier this year by Assembly member Tom Ammiano (D-San Francisco) and others.

“More than 15 years after Californians passed Proposition 215, patients are still in need of a commonsense approach to the production and distribution of medical marijuana,” said Don Duncan, California Director with Americans for Safe Access. The bill would assist patients in accessibility of medicine while increasing revenue for California significantly.

The implementation of the bill is largely thanks to a grassroots movement, led by Americans for Safe Access. More than 300 patients and policy advocates stormed the Capitol, meeting with each member of the state legislature and urging them to pass the bill. AB 2312 will now proceed to the State Senate, where it must pass out of committee by July 6th and must come to a Senate floor vote by August 31st.

Connecticut
In May, Connecticut passed a bill to legalize medical marijuana for illnesses such as cancer, glaucoma, epilepsy and Chrohn’s disease…and it passed! Connecticut’s government website has all the information. Congratulations on becoming the 17th state to legalize, Connecticut!

New Jersey
The New York Times provides coverage of two soon-to-be dispensaries in New Jersey. Jersey legalized medical marijuana use almost two and a half years ago, but dispensaries have not yet opened.
