Medical Marijuana News From Coast to Coast

Despite the setback in Los Angeles as a dispensary ban is considered, the medical marijuana cause is still going strong with very positive news across the country.  It’s still unclear if the Los Angeles ban, which would hurt both patients and the economy, will go into effect. Meanwhile, in Sacramento positive steps are being made for the regulation of medical marijuana. Even more encouraging is the fact that Connecticut has officially passed its medical marijuana law. Finally, New Jersey is on the verge of opening its first dispensaries.

California
Los Angeles
Earlier this week, a three-person council voted to shut down medical marijuana dispensaries in the Los Angeles area and outlaw new ones from opening. The city has struggled with regulation of distribution for years, but shutting down the dispensaries will only make it more difficult for patients to receive treatment and will leave hundreds unemployed. It is being argued that banning dispensaries will only take the industry back to dealing illegally – and dangerously.  A highly supported counterproposal was advanced to leave 100 dispensaries open.

Sacramento
In a 41-28 vote, the California State Assembly passed a bill that would regulate the production and distribution of medical marijuana for qualified patients. AB 2312, the Medical Marijuana Regulate, Control and Tax Act, was introduced earlier this year by Assembly member Tom Ammiano (D-San Francisco) and others.

“More than 15 years after Californians passed Proposition 215, patients are still in need of a commonsense approach to the production and distribution of medical marijuana,” said Don Duncan, California Director with Americans for Safe Access. The bill would assist patients in accessibility of medicine while increasing revenue for California significantly.

The implementation of the bill is largely thanks to a grassroots movement, led by Americans for Safe Access. More than 300 patients and policy advocates stormed the Capitol, meeting with each member of the state legislature and urging them to pass the bill. AB 2312 will now proceed to the State Senate, where it must pass out of committee by July 6th and must come to a Senate floor vote by August 31st.

Connecticut
In May, Connecticut passed a bill to legalize medical marijuana for illnesses such as cancer, glaucoma, epilepsy and Chrohn’s disease…and it passed! Connecticut’s government website has all the information. Congratulations on becoming the 17th state to legalize, Connecticut!

New Jersey
The New York Times provides coverage of two soon-to-be dispensaries in New Jersey. Jersey legalized medical marijuana use almost two and a half years ago, but dispensaries have not yet opened.

Surprising State Joins MMJ Debate

Now that election season is upon us, lawmakers and voters are particularly riled up about medical marijuana in key states such as New York, California, Ohio, and Massachusetts. Now, a measure proposed in Fargo could make North Dakota the 18th state to approve medical marijuana use. The 22-page proposed law would require a doctor’s permission for marijuana use and they can only get the medicine from a state-approved dispensary.

The measure comes just a couple of weeks following Connecticut’s adoption of a similar law. Whereas we can hope that Connecticut’s decision may affect Massachusetts and New York, it is unclear what will follow North Dakota’s vote. In fact, North Dakota’s level of support is relatively unknown. Its neighbor Montana already allows medical marijuana use, but South Dakota has rejected laws twice in the past six years.

According to Medical Marijuana Business Daily, in order for the law to pass:

“the secretary of state must first give organizers the green light to begin gathering signatures. Supporters will then need to get enough people to sign the petition to qualify it for the November ballot, and then voters would have to approve the initiative for it to become law. In other words, there’s a long way to go. But it’s an encouraging sign nonetheless, as it furthers the MMJ debate.”

If North Dakota passes the proposition, the country will be only 8 states shy of a majority of states which have passed medical marijuana legislation.  Watch our blog for up-to-date news following the medical marijuana debate across the country.

Medical Marijuana News Around the US

Recently, the President tried to defend the recent crackdown on the medical marijuana industry, including raids of legitimate businesses without explanation. While medical marijuana-sympathetic voters generally choose a democratic candidate, voters are now conflicted over who to vote for. Romney has strongly opposed legalization, and the only candidate who supports legalization is Ron Paul, who is trailing Romney badly in the polls. Meanwhile, state governments are dealing with their own legislation debates:

Colorado Asks Obama to Protect Jobs

Last week, President Obama visited the University of Colorado to reach out to younger voters, and cannabis activists took the opportunity to speak out against the recent government intervention in the MMJ industry.  In a press release, it was stated that the U.S. Attorney’s plan to target nearly 200 medical marijuana businesses would result in over 1,000 jobs being lost in the wake of a recession. Meanwhile, three Boulder dispensaries are shutting down this week after the government gave them an ultimatum of moving locations by May 7 or closing.

Hawaii Sees a Spike in MMJ Patients

Since last summer, the number of Hawaii residents with medical marijuana cards has grown by about 7,600 patients – 27% lift in nine months. Hawaiians with MMJ cards are allowed to use, possess, and grow limited amounts of cannabis, but dispensaries are not allowed to operate. This boost in numbers could help pass legislation allowing dispensary operation and in the meantime it will help the businesses of doctors, lawyers, and those who sell cultivation equipment.

New Hampshire and Connecticut Pass MMJ Legislation

The New England states still face opposition to the bills. New Hampshire’s governor stated that he would veto the bill, but there’s still hope for it yet – only 3 of the 11 Senators opposed the bill, and it is rumored that at least two would change their votes, effectively overriding the veto.  In Connecticut, however, the bill is moving to the Senate and their governor has already stated that he supports MMJ and is more likely to not veto the bill.

Connecticut Passes MMJ Bill

A Connecticut bill allowing medical marijuana use has been passed by Congress and is in the hands of state Governor Malloy, who says he plans to pass the bill. The bill contains some of the country’s strictest regulations for the cultivation and distribution of medical marijuana to try to bypass some of the problems the other 16 states face in legalization. A registry of patients will be established as well as a list of diseases approved to use the drug.
